Benefits of Family Mediation

Family mediation provides a cost-effective method of reaching a reasonable resolution to problems with separation conflicts. Such conflicts can be complex and are often highly emotionally charged. An impartial family mediator, skilled at handling these types of situations, can encourage both parties to remain flexible and find agreeable solutions.

An impartial family mediator will guide both parents to think through the issues that matter most to them for their children and help them to negotiate a workable agreement. Agreements are not legally binding, but they can become the basis of a legal agreement if the parties choose.

There are many benefits of family mediation over the court process for dispute resolution. Some of the benefits are:

  • Cost effective – 80% of mediations result in an agreement. Mediation sessions are usually done over a 3-hour period on up to 6 occasions. This is much more cost effective than court, which can cost thousands of dollars.
  • Transforming hostility –  avoiding the animosity that can result from a court case can mean a more harmonious future for family relationships
  • Waiting times – mediation can occur within a few days, depending on the availability of the involved parties. We strive to provide pre-mediation sessions within seven days of an enquiry and to hold the mediation within two weeks.
  • Confidentiality – Agreements made during mediation are protected by the Family Law Act 1975 and as such are confidential.
  • Family mediation is an informal, non-legal process without rules of procedure that must be followed. The mediator will explain the process to the parties and ensure that they understand what they are agreeing to.
  • Agreement – Family mediation can assist parties to learn to communicate and work together by using a safe environment to have a guided conversation. Agreements reached in this environment are more likely to be workable.
  • Future communication – providing parents with a method of communicating successfully about their children can benefit the whole family in the future
  • Custom made agreements – At family mediation, you have the opportunity to come to an agreement that takes into account your family’s specific needs and requirements. You have the ability to explain your needs and requirements to the other party in a safe and guided conversation and to negotiate an agreement that is fair and takes both sides into consideration.

Family mediation does not guarantee a settlement agreement, and it is possible that you may still end up in court. However, for most cases, mediation results in a mutually agreeable settlement that respects the rights of all parties and keeps parents focused on what is best for their children.
